User May Not:

Send SPAM, or bulk email when dialed into the
network.

Post offensive, threatening, or SPAM, when using the
newsgroups.

Use their personal FTP site for business sites.

Post or transmit viruses or any harmful component to
others.

Transmit anything that is protected by copyright
without permission.

Attempt to violate the security of any computer
network

Engage in any illegal activity.

Share their account information with any other
person.
General Conditions of Use:
You must be at least 18 years of age. If you are under 18 years of age,
then a parent or legal guardian must agree to this service. The parent or guardian assumes
all responsibility for the account. You are required to have a valid authorized account
under your real name, containing true and valid information.
All accounts are strictly limited to one login at a time and may not be
shared among friends or neighbors.
Meadville Online's regular monthly service is unlimited,
meaning you are free to dial in at any time, but it is not to be used as a
dedicated connection. When you are not actively using the system, we ask
that you log off to ensure that connections are available for other active
users. We reserve the right to utilize detection programs to ensure that
customers are not using automated programs just to keep the connection alive. In
these circumstances, we will discontinue the connection. If such activity
continues, we will terminate service. Dedicated dial-up services are available for an
additional charge.
All regular personal and not-for-profit accounts are afforded up
to 4 mailboxes and 30MB of disk storage on our server system for posting of a
personal website.
Personal websites are limited to personal usage only,
posting of commercial websites (including not-for-profit organizations) is prohibited
without prior written permission. No websites may contain any obscene or offensive
materials. Meadville Online personnel will review all personal websites for content
and will restrict access to any account that violates these terms and agreements.
Any use that disrupts the normal use of the system for other customers
is considered to be an abuse of the system and is grounds for administrative intervention.
Some examples of system abuse include spawning excessive processes, consuming excessive
amounts of memory or CPU for long periods of time, and staying attached to modems while
not really "active" on the line.
You are responsible for safeguarding your account and password.
Meadville Online can be reached from any site in the world, thus password security is of
crucial importance.
ANY activity of this sort shall be grounds for the immediate termination
of your account with Meadville Online, as well as the full disclosure of any and
all information relating to this matter to the proper law enforcement authorities for
criminal prosecution. The use of computer and Internet network services are subject to
federal and state regulations, with which you are expected to be familiar. These local
guidelines, which include federal and state regulations, of computer and international
network usage are subject to revision. You as the user are expected to be familiar with
any modifications and/or revisions in the laws and regulations.
Use of any information obtained via this service is at your own risk.
Meadville Online specifically denies any responsibility for the accuracy or
quality of information obtained through our services. Meadville Online does not
warrant that its service will meet any specific requirement you have, or that it will be
error-free or uninterrupted. Meadville Online shall not be liable for any indirect,
incidental, or consequential damages (including lost data, information, or profits)
sustained or incurred in connection with the use, operation, or inability to use the
service, whether caused by our own negligence, or by your own errors or omissions.
Meadville Online makes no warranties, expressed or implied, as to the
merchantability of the service or its fitness for a particular use or purpose.
You agree to read and abide by the definitive terms and conditions of
service (which may be modified at any time without notice), published on the World-Wide
Web at http://www.mdvl.net/policy.html. If you do not agree with the definitive terms and
conditions, log off and contact us. These terms and conditions supersede all
previous representations, understandings, or agreements, and shall prevail notwithstanding
any variance with terms and conditions of any order submitted.
We are not responsible for long distance charges
incurred while dialing our servers. Please make sure you are making a local call before you
dial.
Conditions of Internet Access:
Traffic exiting Meadville Online to SprintNet is governed by the policies
of SprintNet. Violations of this policy will result in the expulsion of the member or
organization from Meadville Online, termination of Meadville Online
services, and forfeiture of all fees paid to date.
E-mail, Data Transfer and Storage Policy
You may use your account only for lawful purposes. Transmission of any
material in violation of federal, state or local regulations is prohibited. This
includes, but is not limited to: copyrighted material, threatening or obscene material, or
material protected by trade secret.
You may not engage in unauthorized duplication, alteration, or
destruction of data, programs, or software on any local or remote system. You agree to
indemnify and hold Meadville Online harmless from any claims resulting from
your use of the service which damage either you or another party.
You may not use computer resources to engage in abuse of local or other
network users. This includes the transmission of obscene messages and the like. You may
not use computer nor network facilities to attempt to breach security on any local or
foreign hosts. Any attempt to enter another computer by means of a back-door program
such as "NetBus" will be cause for your account to be immediately terminated.
Members of Meadville Online are expressly prohibited from uploading or
posting on Meadville Online or using the facilities of Meadville Online to
upload or post any unlawful, libelous, obscene, profane or sexually explicit
information of any kind, or any information which is offensive to the standards
of Crawford County,
Pennsylvania, community, or any information which would give rise to civil or criminal
liability or which would violate any local, state, national or international law. Members
of Meadville Online are expressly prohibited from uploading or posting any
information on Meadville Online or using the facilities of Meadville Online
to upload or post information which is protected by copyright without the express
authorization of the copyright owner.
There is an explicit limit on the number of e-mail messages and data files that
may be sent or received on Meadville Online. Meadville Online
reserves the right to implement and enforce mail, data transfer and/or storage
restrictions if any member's data use or storage becomes so large that it adversely
affects the performance of Meadville Online or the ability of other members to the
use the system. The limit on mail data is 8MB. Mailboxes that exceed
that limit for over thirty (30) days may be purged.

User may not send to more than 50 recipients at a time.

User may not send from an email address that is not their
own.

User may not forge message headers to hide the origin of
their email.

Provider may block certain attachment types used in
transmitting viruses.

Provider may run a virus scanner on all mail and drop mail
containing viruses.
Information stored in a member's electronic mailbox is subject to deletion after
twenty (90) days have passed since the transfer, creation or last modification of that
information, whichever is the most recent.
The sending of unsolicited marketing, advertising, or personnel recruiting
materials via e-mail through the Meadville Online system and to other Meadville Online members is strictly prohibited. This practice is illegal under federal law and
will result in termination of your account and possible criminal prosecution.
We do not and will not perform system backups on any User's
E-mail account(s). We shall not be held responsible for any lost E-mail data,
email attachments, or any E-mail message contents, regardless of the reasoning
for data loss or system causes. Except as otherwise set forth herein, we will
not provide historical data, to any party for any reason, regarding any system
or Internet activity.
Our Rights
To provide the best available service to all members, any member will be
automatically logged-off Meadville Online if there is a period of inactivity of 30
minutes.
Meadville Online reserves the right to shut down the system or portions
of the system to service, repair or maintain the system. Every effort will be made to
notify members in advance of an anticipated shut-down of the system.
Meadville Online reserves the right to terminate the service of any
member for violation of any of the Meadville Online policies, or for any other
reason.
Meadville Online reserves the right to block access to any web
site that is deemed inappropriate or depicts itself as "Meadville Online".
Billing Policies
The account holder acknowledges responsibility for the
account until payment in full is made. If your account is suspended for
non-payment, there may be a $5 fee
for re-activation. Termination of an account due to lack of payment does not remove
your obligation under this agreement to pay all fees incurred up to the date that the
account is canceled, including any collection fees incurred by Meadville Online.
There is a $45 charge for returned checks.
You agree to pay for this account according to Meadville Online's
billing policies. The Meadville Online accounting cycle begins on the first of
account activation. The first day of billing will become the regular billing
date in each subsequent month thereafter If we do not receive your payment when due, your account may be terminated.
Termination of your account does not remove your responsibility under this agreement to
pay all fees incurred up to the date of termination including, but not limited to,
collection and attorneys' fees incurred by Meadville Online. If you decide to
cancel, you must call our office during our normal business hours and speak to a
representative.
Service Cancellation Policy

A customer may cancel their
account by providing thirty (30) days notice to our Billing Department.
A cancellation fee will apply if you fail to give proper notice.

We do not accept email
cancellations. We must have verbal confirmation of the intent to cancel,
and the account information before a cancellation request will be
processed.

If the customer chooses to
close their account, and then reopen it at a later time, the customer is
not eligible for promotions occurring when they reopen their account.
-
Non-use of an Internet account
is not considered to be equivalent to cancellation. Notice must be
provided verbally to terminate billing.

Any account that cancelled
because of non-payment will be sent to collections if payment is not
made within thirty (30) days of becoming delinquent.

Accounts that are cancelled
before the expiration of their subscription time are not eligible for a
refund.
-
Accounts that are
set for automatic credit card payments must give the same notification
for cancellation. Notices less than 30-days will cause your
account to charge one final payment.
User accounts are not transferable.
Important Notice: Payments are non-refundable. Memberships automatically renew
at the beginning of each billing period. Cancellations must be made by either calling
814-333-9613 or e-mailing billing@mdvl.net.
Confidentiality of Communications
Pursuant to the Electronic Communications Privacy Act of 1986, 18 U.S.C. Section
2510 et seq., notice is hereby given that there are no facilities provided by this system
for sending or receiving private or confidential electronic communications. All messages
shall be deemed to be readily accessible to the general public.
Information transmitted through us and through the Internet in
general is not confidential. We can not and shall not guarantee privacy or
protection of any User. We reserve the right to monitor any User's transmissions
when deemed necessary for providing proper service and/or to protect the rights
and property of our company.
Limitation of Liability and Disclaimer of Warranties
Meadville Online does not warrant or guarantee that the services or
information provided by Meadville Online will meet any member's requirements or
expectations, or that the service provided by Meadville
Online will be
uninterrupted or error-free.
MEADVILLE ONLINE SHALL NOT BE LIABLE FOR ANY ACTUAL, DIRECT, INDIRECT,
INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES THAT RESULT OR MAY RESULT FROM THE USE OF
MEADVILLE ONLINE, OR THAT RESULT OR MAY RESULT FROM MISTAKES, OMISSIONS,
NEGLIGENCE, DEFECTS, DELAYS, DELETION OR CORRUPTION OF DATA, ERRORS IN INFORMATION, OR
INTERRUPTION OR DELAY OF SERVICE. Some states do not allow the limitation or exclusion of
liability for incidental or consequential damages, and the above limitation may not apply
to you.
BY USING MEADVILLE ONLINE, EACH MEMBER EXPRESSLY ACKNOWLEDGES AND AGREES
THAT USE OF MEADVILLE ONLINE IS AT THE MEMBER'S SOLE RISK. MEADVILLE ONLINE
ACCESS
IS PROVIDED "AS IS" AND WITHOUT ANY EXPRESS OR IMPLIED WARRANTY OF ANY KIND,
INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A
PARTICULAR PURPOSE. Some states do not allow the limitation or exclusion of implied
warranties, and the above limitation may not apply to you.
Indemnity
The user agrees to indemnify and hold harmless Meadville
Online, agents, employees and its customers from any and all claims,
liabilities, damages, or expenses, including attorney fees, arising out of, or
resulting from, any and all use of Meadville Online services and/or its network,
whether or not authorized
Miscellaneous
In the event that any portion of this Agreement is held to be
unenforceable, the unenforceable portion shall be construed in accordance with
applicable law as nearly as possible to reflect the original intentions of the
parties and the remainder of the provisions shall remain in full force and
effect.
Our failure to insist upon or enforce strict performance of any
provisions of this Agreement shall not be construed as a waiver of any provision
or right. Neither the course of conduct between parties nor trade practice shall
act to modify any provision of this Agreement.
We may modify this Agreement from time to time, and User's
continued use of the Service shall be deemed to be User's acceptance of any such
modification. It is User's responsibility to check this online area regularly to
determine whether this Agreement has been modified. If User does not agree to
any modification of this Agreement, User must immediately stop using the
Service.
This Agreement shall be governed by and construed in accordance
with the laws of the State of Pennsylvania without regard to its conflicts of
law provisions. Any cause of action User may have with respect to the Service
must be commenced within one (1) year after the claim or cause of action arises
or such claim or cause of action is barred.
Venue for litigation of any dispute, controversy, or claim
arising out of, in connection with, or in relation to this Agreement, or the
breach thereof, naming us as the defendant, shall be proper only in a venue
determined by us.
In any action between us and User to enforce any of the terms of
this Agreement, We shall be entitled to recover expenses, including reasonable
attorney's fees.
This Agreement constitutes the entire agreement between User and
us with respect to the Service.
